These Terms and Conditions ("Terms") govern your access to and use of the Kshraum mobile application, related websites, subscriptions, content, features and services (collectively, the "Service"). Kshraum is owned and operated by Suniti Biswas an individual sole proprietor carrying on business under the trade name "Kshraum" ("Kshraum", "we", "us" or "our").
Please read these Terms carefully. They contain important information about subscriptions, device permissions, limitations of the Service, dispute resolution and your legal rights.

You accept these Terms when you download, install, access or use the Service; create an account; start a subscription or trial; or otherwise indicate acceptance in the app. If you do not agree, do not access or use the Service.
These Terms incorporate by reference the Kshraum Privacy Policy and any plan-specific or promotional terms displayed to you before purchase. If a plan-specific term conflicts with these Terms, the plan-specific term will control only for that plan and only to the extent of the conflict. Mandatory law and mandatory Google Play rules will prevail where they cannot lawfully be excluded.
You must be at least 18 years old and legally capable of entering into a binding contract under Indian law to accept these Terms on your own behalf.
Kshraum is not directed to children. A person under 18 may use the Service only under the direct supervision of a parent or legal guardian who has reviewed and accepted these Terms and the Privacy Policy on the minor's behalf and who is responsible for the minor's use. We may restrict or close an account where legally required consent or supervision is not established.
You may not use the Service if applicable law prohibits you from receiving or using it.
Kshraum is a productivity, focus, planning, digital wellness and digital-detox application. Features may vary by device, Android version, plan, region and permissions enabled by you. The Service may include:
The exact features available to you will be those described in the current app interface and purchase screen. Examples in these Terms do not guarantee that a feature is available on every device or plan.
Certain features may require an account created through an available sign-in method, such as Google Sign-In. You agree to provide accurate information and keep it current.
Uninstalling the app does not automatically delete your account, delete cloud-stored data or cancel a paid subscription. Use the available account-deletion process (You may initiate account deletion through Account → Delete Account) or contact support, and separately cancel any subscription through Google Play.
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use the app on compatible devices that you own or control, solely for lawful personal or internal use.
No ownership rights are transferred to you. You may not sell, rent, lease, distribute, sublicense, publicly perform, commercially exploit or create derivative works from the Service except where applicable law expressly permits it despite this restriction.
Kshraum may request Android permissions or special device access only when needed for a feature you choose to activate. Depending on your device and selected features, this may include Accessibility Service, Usage Access, Notification Access, Display over other apps and installed-app visibility or package information.
7.1 Separate disclosure and affirmative choice
Where required, Kshraum will present a separate in-app explanation immediately before directing you to enable a sensitive permission or special access setting. These Terms and the Privacy Policy do not replace that separate disclosure or the affirmative choice required in the app or Android settings.
7.2 Permission-limited use
When you enable a permission, you authorise Kshraum to use it only for the feature and purpose described in the relevant in-app disclosure, permission screen and Privacy Policy. Kshraum must not use permission-derived information for unrelated advertising, sale of data or undisclosed profiling.
7.3 Accessibility Service
Kshraum is a focus and productivity app, not an accessibility tool for persons with disabilities. Where you enable Accessibility Service for a supported focus feature, it may be used to detect relevant on-screen app or browser context and to apply user-configured blocking, redirection or focus overlays. It must operate only in support of rules or actions configured or initiated by you and must not autonomously make unrelated decisions on your behalf.
7.4 Usage Access
Usage Access may be used to identify app usage patterns, calculate focus activity, generate screen-time or app-specific insights, apply user-selected focus rules and support streaks or summaries. Android-generated usage information may be delayed, incomplete or affected by device settings.
7.5 Notification Access
Where you enable Notification Access, Kshraum may process notification-related information only to provide the notification-management, focus or insight feature described before access is enabled. The exact data used and whether it remains on-device or is transmitted will be described in the Privacy Policy and the relevant disclosure.
7.6 Display over other apps
Display over other apps may be used to show a focus screen, blocking notice, timer, reminder or other user-facing overlay when a user-configured rule is active.
7.7 Installed-app visibility
Installed-app or package information may be used to display an app-selection list, identify apps selected for focus restrictions, apply user-configured rules and generate app-specific insights. Kshraum will seek the narrowest access reasonably available for the feature.
7.8 Revoking permissions
You may revoke permissions through Android settings. Revocation may prevent affected features from working, may interrupt an active focus session and may reduce the accuracy of insights. Some device manufacturers may also restrict background operation, alarms, overlays or accessibility services.
Blocking, overlay, grayscale and digital-sunset features can affect access to apps, websites, notifications or device functions. You are responsible for configuring them carefully.
Kshraum is not liable for consequences resulting from a rule, schedule or restriction configured by you, except to the extent caused by our breach of law, gross negligence, fraud or wilful misconduct.
You must use the Service lawfully and respectfully. You must not:
Kshraum may offer free features and one or more paid plans. The current price, billing period, included benefits, renewal type and material restrictions will be shown before purchase. Paid features may vary between monthly, annual, prepaid or other plans supported by Google Play.
Unless the purchase screen states that a plan is prepaid or non-renewing, a subscription is auto-renewing. Google Play will charge the payment method associated with your Google account at the start of each billing period unless you cancel before renewal. Subscriptions provide access only for the applicable entitlement period and do not transfer ownership of the Service.
Kshraum may offer different plans, features or prices to different regions or user groups where law and Google Play rules allow. Any comparison or savings claim displayed in the app must be understood in the context shown on the purchase screen.
A trial, introductory price, coupon or promotional offer is subject to the eligibility, duration and conversion terms shown before activation. Unless stated otherwise, a free trial for an auto-renewing subscription converts to a paid subscription at the displayed price when the trial ends, and Google Play will charge your payment method unless you cancel before the trial expires.
You may be limited to one trial or promotional offer. We may verify eligibility and may withdraw an offer where it is misused, technically erroneous or prohibited by law, while respecting any entitlement already purchased and any mandatory consumer rights.
Google Play processes payments for purchases made through Google Play. Prices may include or exclude applicable taxes as shown at checkout. Currency conversion, bank charges, payment authorisation and payment-method rules may be controlled by Google or your payment provider.
We may change subscription prices for valid business reasons, including changes in features, operating costs, taxes, exchange rates, platform charges or market conditions. A price change will not retroactively alter the price for a billing period already paid. Any increase will be communicated and implemented with the notice, user approval and cancellation options required by applicable law and Google Play rules.
If a payment fails, Google Play may retry the payment, apply a grace period or account hold, suspend paid access or allow the subscription to expire. You remain responsible for valid charges incurred before cancellation.
You can manage or cancel a Google Play subscription through Google Play's subscription centre. Where required by Google Play policy, Kshraum will provide an easy-to-use link or method within the app's account or subscription settings.
Refund eligibility for purchases made through Google Play is governed by applicable law, Google Play's refund rules and this section. Cancellation by itself does not automatically create a refund for a billing period already charged.
Google Play may consider certain refund requests made shortly after purchase. For later requests, purchase-delivery problems or a service that does not work as described, you may contact us at support@kshraumapp.com. We may investigate and, where appropriate, issue or support a full or partial refund through available Google Play tools.
Except where required by law, Google Play policy or an express written offer, fees are non-refundable for change of mind, partial use, unused time after voluntary cancellation or failure to cancel before renewal. Nothing in this section limits remedies available for defective services, unauthorised transactions, misleading representations or other rights that cannot be waived under consumer law.
Kshraum is intended to support focus, planning and digital wellness, but results depend on your behaviour, configuration, device and environment. We do not guarantee:
Insights are estimates generated from available app and device data. They should not be treated as audited records, employment records, medical assessments or evidence of legal compliance.
You may enter or upload content such as profile information, task text, schedule titles, reminder details, blocked keywords, URLs, notes, preferences and feedback ("User Content"). You retain ownership of your User Content.
You grant us a limited, non-exclusive, worldwide and royalty-free licence to host, store, reproduce, process, transmit, synchronise and display User Content solely as reasonably necessary to provide, secure, support and improve the Service, comply with law, and exercise rights under these Terms. This licence ends when the relevant content is deleted, subject to reasonable backup retention, legal obligations and the Privacy Policy.
You are responsible for ensuring that your User Content is lawful, accurate and does not infringe the rights of another person. Do not enter highly sensitive information unless it is necessary for your intended use and the Privacy Policy clearly explains how that information is handled.
Our collection and processing of personal data is described in the Kshraum Privacy Policy available at https://www.kshraumapp.com/privacy-policy.html. The Privacy Policy forms part of these Terms for matters relating to personal data.
We will process personal data in accordance with applicable Indian data-protection law, including the Digital Personal Data Protection Act, 2023 and rules brought into force under it, as applicable to Kshraum. Permission access does not by itself authorise use beyond the purpose separately disclosed to you.
The Privacy Policy should explain the categories of data processed, purposes, legal basis or consent where required, service providers, data sharing, retention, security, cross-border processing where applicable, account deletion, children's data, grievance contact and the rights available to users.
Where these Terms conflict with the Privacy Policy on the handling of personal data, the Privacy Policy will control, except where applicable law requires otherwise.
The Service may depend on or integrate with third-party products and services, including Google Play Billing, Google Sign-In, Firebase Authentication, Firebase Firestore, Android system services, device manufacturers, browsers and analytics or crash-reporting providers disclosed in the Privacy Policy.
Third-party services are governed by their own terms and privacy practices. We do not control their independent acts, outages, security incidents, eligibility decisions or changes. However, this clause does not exclude responsibility that applicable law places on us for our selection, instructions or use of a service provider.
The app may include open-source software governed by applicable open-source licences. Those licences apply to the relevant components and may grant rights in addition to these Terms.
We may release updates, bug fixes, security patches or new versions. Some updates may be required for continued access or compatibility. You are responsible for maintaining a compatible device, supported Android version, sufficient storage, an internet connection where needed and current app updates.
We may modify, replace, suspend or discontinue a feature for security, legal, technical, operational or business reasons. Where a material discontinuation affects a paid entitlement, we will provide notice or a remedy where required by applicable law or Google Play policy.
The Service and all associated software, code, design, text, graphics, interfaces, branding, logos, audio, animations, mascots, databases, documentation and other materials are owned by or licensed to the proprietor and are protected by applicable intellectual-property laws.
Except for the limited licence expressly granted in Section 6, no right, title or interest is transferred to you. Kshraum names, logos and visual identity may not be used without prior written permission. Third-party names and marks remain the property of their respective owners.
If you provide ideas, suggestions, reviews, bug reports or other feedback, you grant us a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable and royalty-free right to use, adapt, reproduce and commercialise that feedback without restriction or compensation, provided that we do not publicly identify you without permission unless your review is already public.
Kshraum is a general productivity and digital-wellness tool. It is not a medical device and does not provide medical, psychiatric, psychological, therapeutic, diagnostic, crisis-response or emergency services. Breathing, detox, reflection or wellness content is general information and is not a substitute for professional advice.
Stop using any exercise or feature if you feel unwell or unsafe. Seek advice from a qualified professional where appropriate. If you are experiencing a medical or mental-health emergency, contact local emergency services or a qualified professional immediately.
You may stop using the Service at any time. To stop future subscription charges, you must separately cancel through Google Play. To request account deletion, use the in-app method where available or contact support.
We may suspend, restrict or terminate access where reasonably necessary because:
Where reasonably possible and lawful, we will provide notice and an opportunity to address the issue. Termination does not affect accrued payment obligations or rights and provisions that are intended to survive, including intellectual property, disclaimers, liability, disputes and general terms.
To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis. We do not make warranties not expressly stated in these Terms, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, uninterrupted availability, compatibility, accuracy or error-free operation.
We do not warrant that the Service will prevent every distraction, remain active after all device or operating-system events, or preserve every item of User Content. You should maintain independent copies of important information.
Nothing in these Terms excludes warranties, guarantees or remedies that cannot lawfully be excluded, including mandatory consumer rights.
To the fullest extent permitted by law, the proprietor, Kshraum personnel, contractors, licensors and service providers will not be liable for indirect, incidental, special, exemplary, punitive or consequential losses, or for loss of profits, business opportunity, goodwill, productivity, anticipated savings or data, arising from or relating to the Service.
To the fullest extent permitted by law, our aggregate liability for all claims arising from or relating to the Service will not exceed the amount you paid for Kshraum during the 12 months immediately before the event giving rise to the claim; if you paid nothing, the aggregate cap will be INR 1,000.
The exclusions and cap do not apply to liability that cannot lawfully be excluded or limited, including liability arising from fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence where applicable, or mandatory rights and remedies under consumer law.
To the extent permitted by law, you agree to indemnify the proprietor against third-party claims, losses and reasonable costs directly arising from your unlawful commercial exploitation of the Service, intentional misuse, infringement of third-party rights, or material breach of Section 9. This obligation does not apply to the extent the claim was caused by our breach, negligence, fraud or wilful misconduct, and does not reduce mandatory consumer rights.
Neither party will be responsible for delay or failure caused by events beyond reasonable control, including natural disasters, war, civil disturbance, government action, telecommunications failure, widespread cloud or platform outage, cyberattack, epidemic, labour disruption or failure of essential third-party infrastructure. Payment obligations already due and rights that cannot lawfully be suspended are not excused.
Nothing in these Terms restricts rights available to a consumer under the Consumer Protection Act, 2019 or other mandatory Indian law. A term that is invalid or unfair under mandatory consumer law will apply only to the maximum extent lawfully permitted.

We will acknowledge receipt of a consumer complaint within 48 hours and endeavour to resolve it within one month from the date of receipt, subject to applicable law. We may request reasonable information to verify identity, locate a transaction, investigate the issue and protect account security.
You remain entitled to approach an appropriate consumer commission, regulator, data-protection authority or other forum where applicable law gives you that right.
29.1 Informal resolution
Before starting court proceedings, the parties should attempt in good faith to resolve the dispute by written notice to the contact details in Section 33. The notice should describe the issue and requested remedy. This step does not prevent either party from seeking urgent interim relief or using a statutory consumer or regulatory process.
29.2 Optional mediation
The parties may mutually agree to attempt mediation through an independent mediator before litigation. Mediation is voluntary unless required by an applicable court or statutory process.
29.3 Governing law and courts
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to mandatory consumer rights and any forum available under applicable law, courts located in Noida, Uttar Pradesh, India will have jurisdiction over disputes arising from or relating to these Terms or the Service.
We may update these Terms to reflect changes in the Service, law, security, business practices or platform requirements. The updated version will state a new "Last Updated" date.
For material changes, we will provide reasonable notice through the app, website, email or another appropriate method before the change takes effect where required. If a change materially affects an active paid subscription, applicable law and Google Play requirements will be followed. Your continued use after the effective date constitutes acceptance, except where the law requires a separate affirmative agreement.
You consent to receive transactional communications electronically, including account notices, security alerts, receipts, subscription information, reminders and changes to these Terms or the Privacy Policy. Communications may be delivered in-app, by push notification, by email or through Google Play.
Marketing communications, where used, will be sent only in accordance with applicable law and available consent or preference controls. You can opt out of marketing without disabling essential service or legal notices.
32.1 Entire agreement
These Terms, the Privacy Policy and applicable purchase or promotional terms form the entire agreement between you and us regarding the Service and replace prior discussions or understandings on the same subject.
32.2 Severability
If a provision is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect.
32.3 Waiver
A failure or delay in enforcing a provision is not a waiver. A waiver is effective only if in writing and only for the specific instance stated.
32.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign them in connection with a sale, reorganisation, transfer of the Kshraum business or operation by a successor, subject to applicable law and notice where required.
32.5 No partnership or agency
These Terms do not create an employment, partnership, joint venture, fiduciary or agency relationship between you and us.
32.6 Headings and interpretation
Headings are for convenience only. "Including" means "including without limitation". Singular words include the plural where the context permits. Any ambiguity will not automatically be interpreted against either party solely because that party drafted the provision.
32.7 Language
These Terms are written in English. Any translation is provided for convenience. To the extent permitted by law, the English version will control in the event of inconsistency.
